Pete Maskow’s practice involves a broad range of litigation matters, including complex business cases, corporate governance disputes, real estate litigation, deceptive trade practice claims, and class actions. Pete has extensive experience in state and federal trial and appellate courts and arbitration fora.

Pete has also represented clients in a wide range of industries, including financial services, resort, real estate development, marketing, technology, insurance, and construction. 

Prior to joining Atherton Galardi, Pete worked for a national litigation firm and served as the in-house litigation director for an international company. His experience as courtroom counsel, boardroom advisor, and business partner gives him a unique ability to deliver value to clients.

Pete is also a Certified Information Privacy Professional – United States (CIPP/US) and has substantial experience with information security and data privacy issues. His background includes coordination of data breach response efforts, consulting on compliance with state comprehensive data privacy laws, working with state legislators on proposed Florida data privacy legislation, and defending litigation brought based on novel data security issues. He also presented on the emerging areas of blockchain, cryptocurrency, and digital assets.

Representative Experience

Represented marketing agency in defense of Lanham Act and trademark infringement claims directed toward creative deliverables and assistance in product launch.

Represented national banks in defense of claims brought pursuant to the Fair Credit Reporting Act (FCRA), Fair Debt Collections Practices Act (FDCPA), Truth in Lending Act (TILA), and Deceptive and Unfair Trade Practices statutes, in addition to defending against fraud claims, alleged violations of bankruptcy injunctions, and violations of other state and federal statutes.  

 Represented lenders in commercial financing litigation and pursued recovery of funds through bankruptcy against secured assets.

Represented national retailer in putative class action asserting violation of the Telephone Consumer Protection Act (TCPA).

Represented national banking association in putative class action litigation brought pursuant to the Real Estate Settlement Procedures Act (RESPA) and Florida Consumer Collection Practices Act (FCCPA).

Represented online information security provider in putative class action claiming violation of Florida wiretapping statute.

Represented clients in disputes over title to real property, litigation involving loans secured by improperly described assets, challenges to enforceability of “evergreen” automatic renewal provisions of commercial leases, questions over validity of commercial lease with quasi-public entity, and conflicts over easement entitlements and usage rights.

Represented national bank in appeal establishing that testimony regarding routine business practices was sufficient to satisfy conditions precedent to enforce debt instrument.

Represented client in appeal affirming that dismissal without prejudice for lack of standing did not operate to prevent subsequent action to enforce security instrument where standing was independently established.
